Compliance
We call it compliance, but you can just call it “no worries”—because if there’s a law, rule or statute to follow, you can be sure that Aurico is up to speed.
We conduct business in accordance with federal laws that govern our industry:
- FCRA, the Fair Credit Reporting Act
- FACTA, the Fair And Accurate Credit Transactions Act
- GLB, the Gramm-Leach-Bliley Act, also known as the Federal Services Modernization Act of 1999
- DPPA, the Driver Privacy Protection Act
- HIPAA, the Health Insurance Portability and Accountability Act
We are also compliant with state laws and regulations, which have become increasingly important over the last few years. In some states, such as California, this process can be more complex than compliance on the federal level.
Our “intelligent” WebACE™ online platform is are regularly updated, so you only see what you’re legally entitled to see. For example, in California, our system won’t let you see criminal convictions that go back more than seven years.
Compliance is such a passion at Aurico that our Vice President of Compliance is available to answer your questions and assist you whenever you need to talk through issues and review scenarios. All managers of Aurico’s Report and Operations departments hold FCRA certification from the Consumer Data Information Association and are also available to answer your questions.
In addition, we maintain strategic partnerships with national law firms that focus on labor and employment law issues, and gain industry knowledge through active participation in leading professional organizations:
- NAPBS – The National Association of Professional Background Screeners
- ASIS – The American Society for Industrial Security
- NCISS – The National Council of Investigation and Security Services
- SHRM – The Society for Human Resource Management
Whenever we become aware of legal changes that affect your business, we’ll alert you through our online systems, compliance updates, and through webinars and whitepapers from the Aurico Institute. We can also work with your legal counsel to help ensure that you are taking proper measures.
As part of the compliance process, when we find information that limits hiring a candidate into an organization, limits a current employee’s eligibility for promotion or may cause him or her to be fired, we go the extra step to handle the entire adverse action and pre-adverse action process on your behalf.
Finally, for drug testing, Aurico is HIPPA compliant, and will help you stay that way too. We closely monitor state and federal drug testing laws and regulations, and work with an expert national partner that enables us to notify you about changes as soon as they occur.
